3. Information regarding the right to cancel
1. Applicability
These Conditions in their current version as of the date of the conclusion of the respective agreement shall exclusively apply for long-distance transactions between yourself and Maria Stransky GmbH. Long-distance transactions are understood to be transactions concluded exclusively by way of one or several means of telecommunication. The term “means of telecommunication” is understood to include electronic mail.Should your conditions differ from those of Maria Stransky GmbH they would only be binding insofar as Maria Stransky GmbH has previously given its express consent in writing. Amendments to the General Conditions will be communicated in a newsletter which also appears on Maria Stransky GmbH’s website (www.maria-stransky.at/shop) and shall be binding thereby. If you are already registered and if you do not wish to give your consent to such amendments you are entitled to have your registration cancelled immediately by sending an e-mail to that effect to shop (@) maria-stransky.at.
2. Conclusion of an agreement
An agreement between you and Maria Stransky GmbH shall be concluded by your placing an order and by Maria Stransky GmbH’s accepting it. Orders shall be placed by completing and forwarding the form available on www.maria-stransky.at/shop. Maria Stransky GmbH will acknowledge receipt of your order by sending you an e-mail confirmation which will contain terms regarding products, prices, delivery, and payment. However, an agreement shall only be concluded by our dispatching the product to you. A confirmation of an order does not constitute a valid acceptance of that order by Maria Stransky GmbH.Maria Stransky GmbH is entitled to decline acceptance of an online order. If an online order cannot be filled Maria Stransky GmbH will inform the customer as soon as possible. We reserve the right to send only such quantities of goods not exceeding the amount equivalent to regular household consumption. If your order exceeds that quantity you will be advised of that fact per e-mail. You will also be informed by e-mail if a product should not be available.
3. Information regarding the right to cancel
You are entitled to cancel your order within 14 days without stating a reason, either in writing (e.g. by letter, fax, or e-mail to the address given below) or by returning the goods. Please send e-mails to: shop (@) maria-stransky.at

• Right to return products and to have them replaced
You are entitled to return all products purchased on www.maria-stransky.at/shop within 14 days after receipt without stating a reason. This right is not subject to restrictions. If a product is returned we reserve the right to demand payment of costs caused by the return.
If you exercise your right to return the product or to have it replaced within 14 days the agreement will be rescinded.

To meet the deadline it shall be sufficient to state your intention to return the product in an e-mail to shop (@) maria-stransky.at within the period mentioned above.
If a product is returned the agreement will be rescinded and payments will be refunded after receipt of the returned goods.
If returned goods should show signs of wear or damage, we reserve the right to demand compensation.
Kindly return the complete product with the original wrapping to ensure prompt handling.
To help us improve our service, please enclose the return note giving the reason for the return.
The product should be returned by registered parcel.
All our products are hand-embroidered. Small deviations from illustrations may occur as every piece is unique.
If there should be any defects in material or workmanship you are kindly requested to register a complaint as soon as possible regarding any visible defects, including transit damage. Within the warranty period of two years after delivery you are first of all entitled to free-of-charge repair or replacement of the product. If necessary we shall replace the product entirely or in part.
If repairs should not be feasible within an adequate period of time you are entitled to choose between a rescission of the purchase and a reduction in price.
4. Delivery; mailing expenses
All our prices are retail prices. Unless otherwise stated they are understood to include VAT.If a product is ordered on www.maria-stransky.at/shop it will be delivered within 7 work days if it is in stock. In the exceptional case of a product being out of stock you will be informed of this per e-mail as soon as possible. Irrespective of the order value we will charge a contribution towards mailing expenses which will only cover part of the costs of postage, shipping and packaging. The remainder will be borne by us. In exceptional cases we may have to charge a higher amount which will be shown in the relevant correspondence concerning the deal. If delivery should have to be made by instalments for technical or logistic reasons, the contribution towards mailing expenses will of course be charged only once. The product will be posted as a standard parcel. Mailing expenses do not include customs charges.
• Collection of the goods at our shop by the customer
There will be no mailing expenses if the goods are collected by the customer at our shop:

• Austria/Germany:
A fixed amount of € 5.- will be charged for mailing expenses.
• EU countries:
A fixed amount of € 15.- will be charged for mailing expenses.
• Other countries:
A fixed amount of € 20.- will be charged for mailing expenses.
5. Retention of title
All products supplied shall remain the sole property of Maria Stransky GmbH until all monies due by the customer to Maria Stransky GmbH have been paid in full.6. Terms of payment; due date
The customer may elect either to pay via credit card or to pay cash in advance. Maria Stransky GmbH reserves the right not to accept certain methods of payment in certain cases.We regret that it is not possible to send cash or cheques by mail. We shall not be liable if cash or cheques are lost in transit..
The purchase price shall be due as follows:
If the customer elects to pay in advance, payment shall be due immediately after conclusion of the agreement.
If the customer elects to pay by credit card, payment shall be due upon dispatch of the goods. 1.
7. Data protection
• Gathering, storing, and protection of dataAll person-related data will of course be kept confidential. All data required for the carrying-out of the transaction will be stored and, if necessary, passed on to the company entrusted with the handling of the order. For the transmission and storing of person-related data appropriate ciphering methods and access control systems will be used for the best possible prevention of unauthorized access. Protection of your payment-related information, e.g. credit card data, is of the utmost importance for us. You are entitled, at any time and free of charge, to be informed about your data stored as well as to have them rectified, blocked, or deleted. You can contact us about this matter by e-mail to shop (@) maria-stransky.at or you can write to our headquarters at the address given below (see “Impressum” – Legal notice). However, we may have to postpone deletion of data in order to safeguard our own rights.
• • Cookies and other identifying tokens
As we wish to present our products to our customers in the most convenient way, we follow the example of many other companies in using “cookies”. Cookies are small text files which make it possible to recognize a user. However, person-related data such as names or addresses are not stored. Thus, you cannot be personally identified by the information provided by the cookies. We use them to respond to your needs in the presentation of our products and to analyse customer response. If you object to cookies being used, you can still make use of our offers. Your browser can be configured to refuse cookies generally or to accept them only if you so decide.
If an order is placed the IP address is stored in the interest of both parties in order to identify the customer in case of disagreements or discrepancies.
8. Advertising
We would like to keep you informed about our products and new developments. However, we are anxious to preserve your privacy and we will only send our catalogues and newsletters to you if you expressly wish to receive them. If you do not desire further communications you can cancel them at any time free of charge. For that purpose please send an e-mail to shop (@) maria-stransky.at.
